The suit NO B/650/2013 between Honourable Justice G.K Olotu V. Leaders
& Company Ltd (Publisher of THISDAY NEWS PAPERS was filled at the
High Court of Justice, Benin City, Edo State on 19th December, 2013 on
behalf of the Claimant who is a Judge of federal High Court by her
Counsel, Chief Dr. Alfred Eghobamien SAN and S.I Ameh, SAN.
The Claimant's claim against the Defendant is as follows:-
(A)The Sum ofN2,000,000,000.00 (Two Billion Naira) only being damages
against the Defendant for the libellous publication in This Day
Newspapers Ltd published on13thof November, 2013 to divers persons in
Nigeria and all over the world.(B.) An order mandating the Defendant to publish a full and unqualified apology(to be given a prominent place)on the front page (7) widely read/circulated newspapers including the defendant’s newspapers and on the internet to the claimant for the said offensive, malicious and defamatory publication.
(C.) An order of perpetual injunction restraining the defendant, her agents, servants, or Libellous material of and concerning the Claimant. And any other order or further orders as this Honourable Court may deem fit to make in the circumstances."
The Claimant intends to call two witnesses to prove her case thus:- (1.) Herself, and (2.) Kola OkeayaInneh SAN, Elder Statesman and leader of the Nigeria Bar in the South South by reason of the fact that he is the most Senior Legal Practitioner in the entire South South Region of Nigeria.
The case came up in Court for mention on 20th January, 2014. The Defendant was not present neither was it represented by Counsel. The Court noted that there was proof of service of the Originating Processes on the Defendant. The Court thereafter adjourned the case to 27th January, 2014 for definite hearing and ordered hearing notice to be served on the Defendant.
